Operator of Second-Largest Music Piracy Cyberlocker in United States Sentenced to 36 Months in Prison for Criminal Copyright Infringement



First Criminal Copyright Infringement Sentence Imposed for a Cyberlocker Operator

The operator of the RockDizMusic.com music piracy website and cyberlocker was sentenced today to serve 36 months in prison, announced Assistant Attorney General Leslie R. Caldwell of the Justice Department’s Criminal Division, U.S. Attorney Dana J. Boente of the Eastern District of Virginia and Special Agent in Charge Clark E. Settles of U.S. Immigration and Customs Enforcement’s Homeland Security Investigations (HSI) in Washington, D.C.

Rocky P. Ouprasith, 23, of Charlotte, North Carolina, was sentenced by Chief U.S. District Judge Rebecca Beach Smith of the Eastern District of Virginia.  In addition to his prison term, Ouprasith was sentenced to serve two years of supervised release and was ordered to forfeit $50,851.05 and pay $48,288.62 in restitution.  On Aug. 21, 2015, Ouprasith pleaded guilty to one count of criminal copyright infringement.

According to admissions made in connection with his guilty plea, between May 2011 and October 2014, Ouprasith operated RockDizMusic.com, a website originally hosted on servers in France and later in Canada, from which Internet users could find and download infringing digital copies of popular, copyrighted songs and albums.  Ouprasith admitted that he obtained digital copies of copyrighted songs and albums – including “pre-release” songs that were not yet commercially available to consumers – from online sources and encouraged and solicited others, referred to as “affiliates,” to upload digital copies of copyrighted songs and albums to websites, including RockDizFile.com, that were hosted on servers in Russia, France and the Netherlands, and that hosted hyperlinks to content being offered for download on RockDizMusic.com.  Ouprasith further admitted that to encourage such activity, he agreed to pay the affiliates based on the number of downloads from his website.

According to the Recording Industry Association of America, in 2013, RockDizFile.com was the second-largest online file-sharing website specializing in the reproduction and distribution of infringing copies of copyrighted music in the United States.  Ouprasith admitted that in 2013 and 2014, he either ignored or pretended to take remedial action in response to complaints from copyright holders and their representatives that the website contained links to infringing copies protected songs and albums.

In October 2014, federal law enforcement authorities shut down RockDizMusic.com and RockDizFile.com, and law enforcement authorities in the Netherlands and France seized file-hosting servers utilized by Ouprasith.

According to court documents, the market value of Ouprasith’s illegally-pirated material was more than $6 million.

This case is being investigated by HSI.  The case is being prosecuted by Assistant Deputy Chief for Litigation John H. Zacharia of the Criminal Division’s Computer Crime and Intellectual Property Section (CCIPS) and Assistant U.S. Attorney Randy Stoker of the Eastern District of Virginia.  The CCIPS Cyber Crime Lab and the Criminal Division’s Office of International Affairs, as well as Dutch, French and Canadian law enforcement officials have provided significant assistance.

Work: Human-Machine Teaming Represents Defense Technology Future

SIMI VALLEY, Calif., November 8, 2015 — Defense Secretary Ash Carter and Deputy Defense Secretary Bob Work are wrestling the future to the ground to give the nation an advantage over adversaries and Work says their best new idea is to team troops up with machines.

Speaking last night at the closing session of the annual Reagan National Defense Forum here in Southern California, Work and moderator Thom Shanker discussed a way forward for DoD called the Third Offset Strategy.

“Offset strategies [involve] great powers,” Work said, “and are focused on one thing … and that is making sure that our conventional deterrent is absolutely as strong as possible” to seriously lower the chances that America would go to war.

Work said the United States has never tried to match a great power tank for tank, ship for ship, airplane for airplane or person for person.

“Generally what we try to do is offset,” he added, noting that the first national offset took place in the 1950s when the nation could use tactical nuclear weapons to deter a conventional attack on Western Europe.

Great Powers

The second took place in the early to mid-1970s, Work said, when the Soviet Union gained strategic nuclear parity with America and the United States went after conventional weapons with near-zero miss -- or precision-guided -- weapons.

Offsets are focused on the operational level of war, or campaigns, he added, and on conventional deterrence against great powers.

Work used international relations theorist John Mearsheimer’s definition of great powers in the nuclear age as those that have nuclear deterrents that can survive a nuclear strike and that also have formidable conventional forces.

But offsets are not just about technology, he added.

“There's always a strong technological component but it is strategy based … ” Work said. “You also want operational and organizational constructs that give you an advantage and an offset against your adversaries, who might outnumber you.”

Third Offset Strategy

Over the past 12 months of effort on elements of the third offset strategy, Work said the department has begun to make investments guided by the strategy and that the big idea right now for deterrence is human-machine collaboration and combat teaming.

The deputy secretary said such collaboration and combat teaming has five basic building blocks and is based on two major efforts.

One was an offset-strategy initiative called the Long-Range Research and Development Program that focused, Work said, on “how to go up against great powers in a conventional sense when they have as many guided weapons as you do and a home-field advantage.”

The second effort was a Defense Science Board Summer Study on Autonomy, he said.

“To a person, [everyone] on the summer study said we can't prove it but we believe we are at an inflection point on artificial intelligence and autonomy,” the deputy secretary added.

Artificial Intelligence and Autonomy

Learning machines are an example of technology that can help turn AI and autonomy into an offset advantage, Work said.

“Learning machines … literally will operate at the speed of light. So when you’re operating against a cyber attack or an electronic attack or attacks against your space architecture or missiles that are screaming in at you at Mach 6,” he said, “you [need] … a learning machine that helps you solve that problem right away.”

Another building block, human-machine collaboration, was in the news in 1997 when IBM supercomputer Deep Blue beat chess grandmaster Garry Kasparov -- the first defeat of a current world chess champion to a computer under tournament conditions.

Then in 2005, Work said, “two amateur chess players using three personal computers won $20,000 in a chess tournament against a field of supercomputers and grandmasters.”

Human-Machine Collaboration

As chess grandmaster Garry Kasparov wrote about human-computer chess playing in a recent review of a book about AI and the human mind, “Human strategic guidance combined with the tactical acuity of a computer was overwhelming.”

Work says, “The way we will go after human-machine collaboration is allowing the machine to help humans make better decisions faster.”

Automated systems use algorithms based on old data, he said, noting that the coming technology assumes a thinking adversary who is constantly changing strategies.

The best example of such collaboration is the F-35 Joint Strike Fighter, he added.

“The F-35 is not a fighter plane, it is a flying sensor computer that sucks in an enormous amount of data, correlates it, analyzes it and displays it to the pilot on his helmet,” Work said.

Machine-Assisted Operations

“We believe and we say it over and over,” he added, “this fifth-gen fighter, [even though] it can't out-turn an F-16 or … go as fast, we are absolutely confident that F-35 will be a war winner … because it is using the machine to help the human make better decisions.”

Work said the third building block is machine-assisted human operations.

He added, “Assisted human operations, wearable electronics, making sure that our warfighters have combat apps that help them in every single possible contingency -- we can do this.”

The fourth building block is human-machine combat teaming and the fifth is autonomous weapons, the deputy secretary said.

Take those five building blocks and put them on a single network where everything is learning at the speed of light, and that is the reconnaissance strike complex of the 21st century, Work said.

A Period of Experimentation

Achieving this important advantage will take some time, he added.

“Essentially we said here's our second offset strategy in 1975. Fifteen years later in the Gulf War there were more bass fishermen in the United States who had GPS receivers than people in the U.S. military,” Work said.

At the time only a small segment of the U.S. force was configured to fire guided munitions, he said, noting that the department today is in a period of experimentation.

The enduring value proposition of the third offset strategy, Work explained, “is that if we force … an adversary that is an authoritarian power to adopt the offset strategy’s organizational and operational concepts, that will cause changes in their military and ultimately their society that will make it less likely that we will fight against each other.”

But Work said the offset strategy isn’t all about technology.

“The No. 1 advantage we have is the people in uniform and our civilian workforce and our defense industrial base and the contractors who support us,” he added.

An iCombat World

In this offset, young officers who have grown up in an iCombat world will have ideas that senior officers simply won’t be able to emulate, Work said.

That’s not an indictment, he added, noting that Yann LeCun, Facebook’s artificial-intelligence director, says old people’s creativity is based on information they know and young people’s creativity is based on information they don't know, allowing for a little wider exploration.

“What will happen is that our senior military officers who know combat at the campaign level, something our junior officers don't know, will be able to make the leap to the operational concepts and organizational constructs,” the deputy secretary said.

If “we can tap into the captains and majors and lieutenants who have grown up in this world and we can manage that creativity together [with older, more experienced officers],” then great results can be produced, Work said.

Reserve experts complete second-to-last GPS IIF Launch

11/4/2015 - SCHRIEVER AIR FORCE BASE, Colo. -- When you watched the series finale of one of your favorite television series, you probably got misty eyed and remembered where it all began, thinking back through the ups and downs of your favorite starship captain, mobster or desperate housewife. The show itself might have even reviewed its own history. When you reach the end of an era, it's only natural to take a look back.

After 15 years of launch operations for the Global Positioning System, 19th Space Operations Squadron Reservists just completed their 26th launch as a squadron Oct. 31, performing checkout operations on the 11th GPS IIF satellite. Only one more IIF remains before GPS III launch and checkout operations will transition to Lockheed Martin.

"I worked GPS launches in the 1st Space Operations Squadron back in the 1990s," said Tech. Sgt. Giovanni Carotti, 19 SOPS mission chief, whose career is the perfect bookend to military GPS launch operations. "Not a lot of us are still around from those days, I'm glad to have seen the beginning and to be here for the end."

In December 1989, 1 SOPS assumed control of launch and early orbit operations for the Global Positioning System including satellite activation, initial checkout and transfer to mission orbit. On Oct. 1, 2000, 19 SOPS stood up, in part, to surge with, and support, GPS launches. The last 1 SOPS support to GPS was done December 2007, before transitioning to the 2nd Space Operations Squadron, the active duty unit responsible for day-to-day GPS operations. The personnel of 19 SOPS, the Reserve associate unit to 2 SOPS, maintain operational continuity and expertise, and to this day remain the launch leaders for GPS.

"When you consider how this squadron has supported the launch and checkout for the vast majority of GPS satellites in today's constellation, and you consider the impact GPS has made on our military, our economy and our world, you can't help but feel pride for the men and women of 19 SOPS, both past and present," said Lt. Col. Sam Baxter, 19 SOPS commander. "Our citizen Airmen provide our nation a tremendous capability by supporting GPS operations at a taxpayer bargain, as the majority of the squadron serves part-time, surging for unique requirements like launch and satellite checkout."

With their final launch support scheduled for Feb. 3, 2016, 19 SOPS is getting ready for the last episode. When the credits roll, they can be proud of serving billions of users for 15 years, 27 launches and a lifetime of memories. Those are better ratings than any show on television. But they won't be finished there.

"We're now applying our same honed launch processes to satellite disposal operations, "said Capt. Stephanie Scott, launch lead and Satellite Vehicle Operations director. "We're planning on disposing of older GPS satellites with fewer capabilities that are well beyond their life expectancy, at a rate of two per year for the next few years."

In addition to normal GPS operations, 19 SOPS will continue to support navigation warfare and ground segment modernization efforts.

Cradle-to-grave GPS operations is part of the 19 SOPS' vision statement, a hallmark of pride for 15 years.

Florida Scouts converge at AFTAC to earn Nuclear Science Merit Badge

11/2/2015 - PATRICK AIR FORCE BASE, Fla.  -- Members of the Air Force Technical Applications Center hosted an annual workshop for area Boy Scouts Oct. 24 in an effort to help them earn the Nuclear Science Merit Badge.

Forty-four scouts from Orange, Indian River and Brevard counties - 11 troops in all - traveled to Patrick AFB to learn about the Department of Defense's sole nuclear treaty monitoring center and listen to center volunteers talk about nuclear science.

The boys began the morning in a classroom setting, where they received a welcome briefing from Lt. Col. Suzanna McNabb, deputy of AFTAC's nuclear sciences division, and an introduction to what a nuclear treaty monitoring center actually does.  After the briefing and a question-and-answer session, the boys began constructing 3-D models of elements and isotopes using gummy bears; learning the nuclear fission process; and creating cloud chambers out of petri dishes.

Throughout the day, each scout was required to make written entries in their handbooks, which included observations, notes from each presentation, and what they learned during the hands-on practicals.  Their materials were reviewed for thoroughness and accuracy, and if all criteria were met, they received their signed merit badge cards, officially awarding them their Nuclear Science Merit Badge.

Prior to visiting AFTAC's lab area, the boys, scoutmasters and parents enjoyed a barbeque lunch at the center's outdoor patio, fondly referred to as Stonehenge (due to the concrete blocks that circle the patio area).  Once the boys' hunger was satisfied, they were escorted to the lab and warehouse, where center volunteers manned stations with various equipment and experiments on display.

One such experiment was conducted by Tech. Sgt. Michael Stolp, noncommissioned officer-in-charge of radiation protection.  Stolp showed the scouts how to use survey instrumentation to demonstrate the ALARA (as low as reasonably achievable) principle pertaining to radiation exposure.  He displayed very low grades of radioactive sources - cesium, americium and plutonium - and used different levels of shielding to illustrate to the boys what types of materials can be used to shield the alpha, beta and gamma emitters.

Another AFTAC volunteer, Master Sgt. Chad Taguba, a physicist at the center, demonstrated what happens when liquid nitrogen is placed in an extremely low-pressure environment, exhibiting a unique property of matter known as a substance's 'triple point.'

Connie Cook escorted her grandson, Codey Smithson from Troop 772 in Palm Bay, to the merit badge day and was very impressed.

"This has got to be the most amazing opportunity ever!" she exclaimed.  "All these young Airmen are just so intelligent and talented and I am so grateful beyond words.  Codey said to me at lunchtime, 'Grandma, I couldn't keep up on my notes because I was just so enthralled with everything!'  It truly has been such a meaningful experience and we can't thank AFTAC enough."

This year's project officer, Staff Sgt. David A. Pettinelli, AFTAC's laboratory measurements supervisor, was extremely pleased with the turn out and how the program came together.

"A lot of behind the scenes planning and preparation brought event together, and without the help of the 17 volunteers who took time out of their weekend schedule, it definitely wouldn't have been the success it was," said Pettinelli.  "We were able to brief on four STEM-related (science, technology, engineering and math) areas in an effort to not only help the Scouts earn the badge, but also to encourage them to pursue STEM fields later in life.  It's definitely no easy task to guide young minds along the path of comprehending this level of science, but the folks here at AFTAC are really experts in their fields and did well to inform and inspire our local youth.  I'm proud to have been a part of it."

The Nuclear Science Merit Badge is earned by less than one percent of Boys Scouts worldwide.

JBSA-Lackland hosts USAF first Cyberspace LVC workshop

10/30/2015 - JBSA-LACKLAND, San Antonio, Texas -- The U.S. Air Force conducted its first Cyberspace Live, Virtual and Constructive (LVC) workshop at JBSA-Lackland 20 - 22 October.  In conjunction with 24th Air Force - AFCYBER, the Air Force Agency for Modeling and Simulation (AFAMS) led the 3-day workshop focused on enterprise LVC and cyberspace technologies.

AFAMS is the lead agent for centralized management of Air Force cross-functional and shared Live, Virtual and Constructive Operational Training (LVC-OT) foundational capabilities, and resources supporting the Air Force Core Missions. Organizers developed the workshop not only based on cyber threats facing the nation, but emphasized the importance of continued integration of cyber technology and LVC.

The workshop also consisted of briefings and discussion panels to develop recommendations and capture action items focused on training for cyber operators and warfighters who depend on cyber capabilities.

Maj. Gen. Ed Wilson, 24th Air Force commander, provided the keynote address, detailing a number of initiatives to align the efforts of 24 AF with those of the Combat Air Forces.  He explained the concept of implementing a Director of Cyber Forces (DIRCYFOR), and how a new leadership position can provide the critical link to coordinate cyber activities with those of the air operations center.  As a leader in realistic cyber training and operations, the general emphasized an AF need for LVC in strengthening warfighter readiness; reiterating the commitment of Air Force leadership and continued integration of air, space and cyberspace training into full-spectrum capabilities.

The workshop was not limited to cyberspace professionals.  Col. Cloyce Adams, USAFE Warrior Preparation Center commander, talked about his experience as an Electronic Warfare Officer and how 700 hours of combat experience in the F-15 Strike Eagle and F-14 Tomcat prepared him for the rapid development of AF cyber technology.  As the commander of a premier AF training center focused on honing warfighter skills, Adams is aware of the requirement to integrate cyber not only into AF training programs, but also planning and operational execution.

The workshop brought together a broad audience of participants to also discuss current cyber events and the future of cyber-security training and operations.  In attendance were military and industry representatives including Headquarters Air Force, Office of the Under Secretary of Defense - Acquisitions, Technology, & Logistics, Pacific Command, five AF Major Commands, the Air Force Research Lab and several subordinate units.  Other support entities included the U.S. Army and several national research labs.

The workshop was a success with the efforts and coordination by Mr. James Hird, Distributed Mission Operations Center (DMOC-Cyber) director, and the entire staff at the 90th Information Operation Squadron as hosts to this year's event.  "While we hoped for a larger audience, the depth and breadth of the participation was fantastic," said Hird.  "We couldn't have had a better group to cover this multi-dimensional problem."

AFAMS facilitator and DoD LVC Integration lead, Mr. Mike McGee is also optimistic. "I think we hit a homerun with this workshop!  However, we must remember we are still in the first inning.  There is more work to be done," McGee stated.

Lt. Col. Kylie Weigle, 24 AF Chief of Operations and Training, and LVC workshop facilitator agreed and suggested annual workshops in an effort to continue the working relationships and strategic development between cyber and LVC. "We are already looking at next year's calendar and determining an appropriate time between major exercises for our next workshop," Weigle said.  "We don't want to lose the momentum we've started.  With more time to plan next year's workshop, we can be even more effective at identifying solutions to the challenges that exist today," he added.

"LVC is the best way to be ready; to have the best tools out there. The goal is to sustain and enhance readiness by enabling effective, relevant, realistic, and efficient training and test in a secure, persistent, and ultimately global LVC domain for Air, Space, and Cyberspace," said McGee.

GPS IIF satellite successfully launched from Cape Canaveral

10/31/2015 - LOS ANGELES AIR FORCE BASE, El Segundo, Calif. -- The U.S. Air Force successfully launched its 11th and next-to-last Boeing-built Global Positioning System GPS IIF series satellite aboard a United Launch Alliance Atlas V 401 launch vehicle from Space Launch Complex 41, Cape Canaveral Air Force Station, Fla. at 12:13 p.m. EDT (9:13 a.m. PDT).

"The successful outcome of today's mission is due to the tremendous commitment of a world class team focused on mission success," said Col. Steve Whitney, director of the Space and Missile Systems Center's Global Positioning Systems Directorate. "I am pleased to say it's truly an honor and privilege to be part of a mission that plays such a critical role in our nation's infrastructure. To the men and women of SMC, the 45th, 50th, 310th Space Wings, Boeing, United Launch Alliance, The Aerospace Corporation, GPS IIF and the Atlas V launch teams, thank you!"

GPS IIF satellites provide improved signals to support both the warfighter and the growing civilian needs of a global economy. Featuring a new operational third civil signal -- L5 -- that benefits commercial aviation and safety-of-life applications, the GPS IIF series provides improved accuracy through advanced atomic clocks, a longer design life than previous GPS satellites on orbit.
